A group of lawmakers is joining NTEU in calling for the reversal of a Merit Systems Protection Board (MSPB) decision that could expand presidential firings across the career federal workforce.
Forty-six House and Senate Democrats filed an amicus brief with the U.S. Court of Appeals for the Federal Circuit urging it to reverse a March MSPB decision upholding the firings of two federal immigration judges. The MSPB decision opens the door for other federal workers to be fired unfairly for political reasons, with no due process.
“The potential consequence here is that the [Civil Service Reform Act] is functionally eliminated and federal employees will no longer have protections against arbitrary removal, reprisal, or the assurance of due process,” the brief states.
Last month, NTEU filed our own amicus brief in the case, underscoring that federal workers should be able to perform their work without fear, regardless of what political parties they support.
