Supreme Court Decision is a Win for NTEU

Last May, NTEU filed a brief in the U.S. Supreme Court urging it to allow interested parties, like NTEU, to go directly to federal district court when challenging wrongful executive branch actions. In fighting for our members’ rights, NTEU has sometimes been blocked from filing suit directly in federal court.

On April 14, the Supreme Court issued a unanimous decision in which it agreed with NTEU’s position that some challenges to agency action may be brought directly in federal court, without first proceeding through a slow administrative process. This decision may help us if we need to bring constitutional challenges to illegal actions by future administrations.
