    D.C. Judge Issues Opinion Explaining NTEU Victory over Exclusions
     
    Today, the judge who granted NTEU a preliminary injunction against the Executive Order that excludes tens of thousands of NTEU members from the labor statute issued an opinion that explains his reasoning. He agrees with NTEU's claims that the executive order violates our labor statute. Because the judge concluded that NTEU would likely prove its two statutory claims, he did not address NTEU's First Amendment claim. It is common for judges to avoid constitutional questions when possible. 
     
    We anticipate that the government will promptly appeal our victory to the D.C. Circuit. We are prepared to defend it.  And we are pressing our agencies to comply with the judge's order in the meanwhile. We will keep you posted on further developments.
