NTEU's Exclusion Lawsuit Continues on Two Fronts
NTEU’s legal challenge to the Executive Order stripping collective bargaining rights from about two-thirds of our bargaining unit employees continues, full steam ahead. First, NTEU continues to press its lawsuit in federal district court. Earlier this week, NTEU filed a motion for summary judgment with the court. A motion for summary judgment asks the judge to decide the legal claims based on undisputed evidence. The government will likewise file a motion for summary judgment with the court later this month. Briefing on those dueling motions will conclude on July 17. After that, if the judge agrees that no significant facts are in dispute, he will decide whether or not NTEU has shown that the Executive Order is unlawful. Second, NTEU's litigation at the D.C. Circuit regarding the emergency relief that the federal district court ordered in late-April continues. NTEU has asked the full D.C. Circuit—all 11 active judges—to overrule a decision from a three-judge panel of the D.C. Circuit. That three-judge panel decision paused the emergency relief the federal district court ordered. If the full D.C. Circuit puts that emergency relief back in place, it would prohibit agencies from implementing the Executive Order while NTEU's litigation proceeds. The D.C. Circuit has ordered the government to respond to NTEU's request to the full court by June 17. We will keep you updated on our efforts to stop this unlawful Executive Order. |
