Another Federal Judge Rules that Exclusion Executive Order is Unlawful
A federal judge in the Northern District of California ruled yesterday that the Executive Order that strips collective bargaining rights from most unionized federal employees (including about two-thirds of NTEU's bargaining unit employees) is likely unlawful. The judge thus granted a preliminary injunction that halts implementation of the Executive Order against the unions involved in that lawsuit. It is very likely that the government will appeal this decision in the next few days. The judge's ruling makes him the second judge to conclude that the Executive Order is likely unlawful. Two months ago, the judge overseeing NTEU's litigation against the Executive Order in the District of Columbia likewise held that the Executive Order is likely illegal. Although a three-judge panel of the D.C. Circuit Court paused that ruling, NTEU has requested review from the full complement of active judges on that Court, with the goal of having our preliminary injunction restored. We await the ruling and continue to press our case at the D.C. District Court as well. We applaud the California judge's decision. The fight against the President's anti-union Executive Order continues on all fronts, and we will continue to keep you updated. |
