D.C. Circuit Fast-Tracks Exclusions Order Litigation
Yesterday, the D.C. Circuit issued an order regarding the government's appeal of the preliminary injunction that NTEU won back in April in the Exclusions Order litigation. That appeal has been proceeding at the D.C. Circuit while NTEU also pursued summary judgment before the district court. In an order issued yesterday afternoon, the D.C. Circuit said the briefing on the preliminary injunction would continue as scheduled and that NTEU's case would be set for oral argument in December—which is much earlier than would have been expected. And the Court stated that NTEU's case will be argued with two other cases involving preliminary injunctions against the Exclusions Order. That means that the same three-judge panel will decide all three of those cases. We are looking forward to defending our district court victory. We will keep you updated as things progress. |
