Supreme Court Sides Today with NTEU
The Supreme Court issued two decisions today of significant importance to NTEU members. In each decision, the Court ruled in the way NTEU urged in our briefs.
The Supreme Court held, 7-2, that the way the Consumer Financial Protection Bureau is funded is constitutional. It reversed a lower court ruling that the Bureau’s funding mechanism violated the Appropriations Clause of the Constitution. NTEU filed an amicus brief last summer in support of the Bureau’s important work and explaining why its funding structure was fully lawful.
The Supreme Court also issued a decision today unanimously holding that a statutory deadline for employees to appeal adverse decisions by arbitrators or the Merit Systems Protection Board is not a rigid deadline. The deadline can therefore be excused for fairness or other compelling equitable reasons. NTEU had urged this result in an amicus brief filed in January 2024.
