    Biden Revokes Trump EOs on Bargaining, Schedule F

    President Biden today revoked the Trump executive orders (EOs) that limited collective bargaining and employee rights in the federal government. Also today, the new administration has rescinded the Schedule F executive order that threatened our merit-based civil service. NTEU fought tirelessly to beat back these four EOs and welcomes today’s actions that will protect important workplace rights.

    Repealing the trio of May 2018 anti-employee, anti-union EOs has been a top priority for NTEU, which mounted battles against them in court, at bargaining tables and on Capitol Hill. Over the last few years, the EOs have had chilling implications at nearly every bargaining table where contracts were up for negotiation. Agencies relied on the orders to advance take-it-or-leave-it directives threatening critical workplace rights and programs, along with benefits that NTEU negotiated and built upon over decades.

    NTEU deployed an aggressive legal strategy that successfully delayed and minimized the substantial damage these EOs threatened to wreak on the working lives of those we represent. President Biden’s actions today send a clear signal to federal agencies that proposals based on the EOs must be set aside. NTEU is ready to discuss resolutions to our litigation surrounding an implementation of the EOs and engage in good faith bargaining as required by federal law, to reach agreements that are fairly and fully negotiated.

    President Biden also overturned the recent Schedule F EO, attacking the integrity of the nonpartisan, merit-based civil service by replacing merit with political loyalty. This new Schedule F class of career federal employees would be stripped of their basic civil service protections and could be hired or fired at will. NTEU fought vigorously to block this order, filing a lawsuit days after its release and working with congressional allies to introduce legislation blocking it.

    Today is a good day for federal employees. NTEU looks forward to continuing to work with this new administration that has demonstrated, through these early actions, its support for federal employees and their unions.
