NTEU Stands with City Employee in Discrimination Case

NTEU is supporting a city employee in a case that could impact what qualifies as workplace discrimination. The case, Muldrow v. City of St. Louis, was heard by the Supreme Court earlier this month. Jatonya Clayborn Muldrow is a former female police sergeant who sued the city for sex discrimination when she was transferred from the intelligence division to street operations and replaced with a male sergeant.

In September, the union submitted an amicus brief arguing she should not have to show significant impact to press her discrimination claim and that Congress deems all discriminatory job transfers and reassignments as significant enough to challenge. 

“We have extensive experience with the statute that protects federal employees from discrimination, and we believe Ms. Muldrow has a right to pursue her claim over an unwanted transfer, just as a federal employee would,” said National President Doreen Greenwald. 

The case will decide whether Title VII of the Civil Rights Act of 1964 prohibits discrimination in transfer decisions without proof that the transfer caused a “significant disadvantage” or harm to an employee.

The Court is expected to issue an opinion by June 2024 when the term ends.
