Update on Today’s Ruling on the Vaccine Mandate

Earlier today, a federal court in Texas issued a decision that temporarily halts the federal government from enforcing the executive order requiring federal employees be vaccinated against COVID-19.

The government has already filed an appeal to the Fifth Circuit, which could stay the injunction, resulting in the vaccine mandate process moving forward. In the meantime, federal agencies are required to comply with the lower court’s decision.

NTEU will immediately contact all agencies where it represents employees to discuss the status of pending disciplinary actions related to the vaccine mandate. Some have already indicated the enforcement process will be paused.

After thoroughly researching the issue, NTEU concluded that there was no viable path forward to any legal challenge to the federal employee vaccine mandate. NTEU maintains this position and believes today’s decision is not likely to survive legal challenges in higher courts. We will continue to keep you updated on developments.
