    Lawsuit Filed Challenging Mass Exclusions from the Labor Statute

    Today, we struck back against this administration’s illegal attempt to take away the right to union representation at about a dozen agencies and departments where NTEU represents employees. NTEU’s response follows President Trump’s executive order last Thursday, which aims to exclude more than 100,000 NTEU-represented employees from the labor statute. Since 1978, federal employees have had the right to join a union and benefit from collective bargaining. The president took that right away in an effort to silence the voices of federal employees and their representatives.

    NTEU filed a lawsuit in DC District Court challenging the president’s sweeping executive order. The order claims to exclude these dozens of agencies and departments from the labor statute because of national security concerns. The administration’s own documents show, however, that the order is no more than a smokescreen for the president’s policy objective of making it easier to fire federal employees.  

    There is no dispute that the executive order’s purpose is not based in national security but on political animus. A White House Fact Sheet calls out federal unions who have “declared war” on the administration’s anti-federal employee agenda by filing lawsuits—which have recently led to the reinstatement of thousands of employees who had been wrongly fired.

    NTEU’s lawsuit asks the court to declare the executive order unlawful and to stop agency heads from implementing it. We are working with many other federal unions on a strategic and coordinated response to this attack on federal employees. Together, we will fight to ensure that every federal employee is treated with dignity and respect.  

    Solidarity is our strength. We have each other’s back and always will. Together, NTEU members will stand strong together to overcome this challenge and whatever else they throw at us.
